These Terms & Conditions ("Terms") govern your access to and use of this website and any information or materials on it. By using the site, you agree to these Terms and to our Privacy Policy. If you're using the site on behalf of a business, you confirm you're authorised to accept these Terms for it.
About Systorm
This site is operated by Systorm Pty Ltd (ABN 48 680 295 961) ("Systorm", "we", "us"), a software studio based in Sydney, Australia. We design and build custom software for the scrap-metal industry — vendor intake, weighing, inventory, sales, timesheets, and accounting integrations.
This website is informational. It markets our capabilities; it is not itself a product, account portal, or offer to contract. Any work we do for you is governed by a separate written agreement (see Custom engagements).
Use of the site
You may use this website for lawful purposes only. You agree not to:
- Use the site in any way that breaches a law or regulation, or infringes anyone's rights.
- Attempt to gain unauthorised access to the site, its servers, or connected systems.
- Introduce malware, scrape at scale, or otherwise interfere with the site's operation or security.
- Misrepresent your identity or affiliation, or submit false information through our forms.
We may suspend or restrict access to the site at any time, without notice, where we reasonably believe it's necessary to protect the site or others.
Intellectual property
Unless stated otherwise, all content on this site — text, layout, graphics, the Systorm name, logo, and brand — is owned by or licensed to Systorm and protected by Australian and international intellectual-property law.
You may view and print pages for your own reference. You may not reproduce, republish, sell, or exploit any part of the site commercially without our prior written permission. Ownership of intellectual property in custom software we build is dealt with in the relevant engagement agreement, not here.
Custom engagements
Nothing on this site is a quote or a contract. Real project work — scope, price, IP, warranties, support — is set out in a separate written agreement we sign with you.
Enquiring through this site doesn't create a contract or commit either of us to anything. When we agree to work together, we'll put in place a written engagement that covers scope, deliverables, fees, timelines, intellectual-property ownership, support, and confidentiality.
Where that engagement agreement and these Terms conflict, the engagement agreement prevails for that work.
Third-party services
This site and our work may reference or connect to third-party services — for example accounting platforms such as Xero, MYOB, and QuickBooks. We don't control those services, and their own terms and privacy policies apply to your use of them. Links to third-party sites are provided for convenience and aren't an endorsement; we're not responsible for their content or practices.
Disclaimers
This website is provided on an "as is" and "as available" basis. While we work to keep it accurate and online, we don't warrant that it will be uninterrupted, error-free, secure, or free of harmful components, or that the information on it is complete or current.
Information on this site is general and doesn't constitute professional, technical, or legal advice. You should not rely on it as the sole basis for a business decision. These disclaimers are subject to your rights under the Australian Consumer Law.
Liability
To the maximum extent permitted by law, Systorm is not liable for any indirect, incidental, or consequential loss, or for loss of profit, revenue, data, or goodwill, arising from your use of — or inability to use — this website.
Where liability can't be excluded but can be limited, our total liability connected with this website is limited, at our option, to re-supplying the relevant information or paying the cost of having it re-supplied. Liability arising from project work is governed by the relevant engagement agreement.
Consumer rights
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that can't lawfully be excluded. Where those rights apply, they sit alongside these Terms and prevail to the extent of any inconsistency.
Privacy
How we handle personal information is set out in our Privacy Policy, which forms part of these Terms. By using the site, you consent to that handling.
Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Systorm submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
Changes
We may update these Terms from time to time. The current version always lives at this URL, with the "last updated" date at the top. Continuing to use the site after a change means you accept the updated Terms.
